指出2011年7月13日,《中华人民共和国著作权法》第三次修订启动,修订草案第26条规定了利用孤儿作品的强制许可制度。但是,草案针对孤儿作品利用程序缺乏操作性、数字化使用方式的单一性等诸多局限性限缩了强制许可制度的适用范围。探讨孤儿作品利用的法定许可制度正当性基础,并在立法技术上分析孤儿作品法定许可制度的可行性;在实体内容上构建孤儿作品法定许可制度的主体、客体和内容等框架,以期使得孤儿作品的利用模式——法定许可制度更具可操作性。
On July 13, 2011, the third amendment of the Copyright Law was launched and in the 26th article of the draft, orphan works were defined and handled and legal permission to public access to and digital preservation of orphan works were given to digital libraries. However, the draft has its limitations due to two factors, namely, single model of operation and thus poor operability. In this paper, the author discussed the theoretical foundation of the legal regulation, based on which, the author further analyzed the feasibility of legal procedures in an attempt to improve and perfect the draft. Finally, a framework on which the use of orphan works and the evaluation could be done was recommended.
