[目的/意义] 图书馆数字资源长期保存过程中的复制行为受到版权法的规制，厘清图书馆数字复制法律边界对图书馆数字保存的开展具有重要意义。[方法/过程] 基于国际版权法与部分国家国内版权法法律文本，采取比较研究的方法，对当前复制权保护和图书馆基于保存或替换目的所享有的复制权例外进行梳理和分析。[结果/结论] 国际公约及各国版权法对图书馆数字资源保存过程中复制权例外法律边界的宏观塑造集中在"图书馆范围""可复制的作品的范围""限制条件"3个方面，并从4个方面对我国今后图书馆数字保存相关立法提出建议。
[Purpose/significance] The reproduction behavior of digital resources in library in the long-term preservation process is regulated by copyright law,and it is of great significance to clarify the legal boundary of library digital reproduction for the development of library digital preservation.[Method/process] Based on the international copyright law and the domestic copyright law texts of some countries, adopting the method of comparative research, analyzed the current protection of the right of reproduction and the exceptions of the right of reproduction enjoyed by the library for the purpose of preservation or replacement.[Result/conclusion] International conventions and copyright laws of various countries focus on three aspects in shaping the legal boundary of digital reproduction in libraries:"scope of library", "scope of reproducible works" and "restrictions", at last, the paper puts forward some suggestions on the legislation of digital preservation of library in the future.
