[目的/意义] 探究地方公共文化服务保障立法的时代背景、基本原则和关键问题,为推进公共文化服务地方立法提供参考借鉴。[方法/过程] 通过文献回顾与走访调研,对北京市公共文化服务保障立法的必要性、可行性、立法原则和拟解决的关键问题进行分析。[结果/结论] 推动公共文化服务高质量发展、发挥全国文化中心引领示范作用、落实“十四五”重点任务是新时期加快推进北京市公共文化服务保障立法的要求,党中央国务院及市委市政府出台的系列政策文件、公共文化服务体系建设成就、其他省市公共文化服务立法经验为北京市立法指明方向,提供借鉴。北京市应在坚持问题导向、固化成功经验、衔接重大政策、突出地方特色的原则下,重点围绕基本公共文化服务标准制度、公共文化设施建设与管理制度、公共文化服务免费或优惠提供制度、社会化发展制度、融合发展制度、政府监管制度和法律责任等展开制度设计,形成公共文化服务保障立法的地方特色与创新突破。
[Purpose/significance] To explore the background, basic principles and key issues of local public cultural service guarantee legislation, and to provide references for promotinglocal legislation of public cultural service. [Method/process] Through literature review and fieldresearch, the necessity, feasibility, legislative principles and key issues to be solved of Beijing's public cultural service guarantee legislation were sorted out and analyzed. [Result/conclusion] Promoting the high-quality development of public cultural services, giving play to the leading and exemplary role of the National Cultural Center and implementing the key tasks of the "14th Five-Year Plan" are requirements for accelerating the promotion of Beijing's public cultural service guarantee legislation in the new era.The series of policy documents issued by the Party Central Committee and the State Council and the Beijing Municipal Committee and Municipal Government, the achievements in the construction of the public cultural service system and the legislative experience of other provinces on public cultural services have pointed out the direction and provided practical basis and experience for the legislation of Beijing.Under the principles of sticking to the problem orientation, solidifying the successful experience and highlighting local features, Beijing should focus on the designofbasic public cultural servicestandardsystem, public cultural facilityconstruction and managementsystem, public cultural service free or preferential provision system, socialized development system, integrated development system, government regulatory system and legal liability, and form local characteristics and innovative breakthroughs in public cultural service guarantee legislation.
