［目的/意义］ 古籍保护是中华文明的重要载体,也是中华民族宝贵的物质精神财富。基于国家治理视角进行古籍保护法治建设探讨,以助推古籍保护在法治化轨道上运行。［方法/过程］ 根据我国古籍保护治理和法治建设的调查分析,指出当前古籍保护法治建设存在的制度法规盲区、法规碎片化、政策执行不力等问题。［结果/结论］ 提出加强法治治理体系建设和提高法治的执行力,建议将古籍寄存管理等内容纳入保护法律条款,以推进古籍保护走向良法善治。
[Purpose/Significance] The protection of ancient books is an indispensable weight for the great rejuvenation of the Chinese nation and a subsystem of the national governance system. Based on the perspective of national governance, this paper discusses the legal construction of ancient book protection, and promotes the operation of ancient book protection on the track of legalization. [Method/Process] Based on the investigation and analysis of the status of ancient books protection and legal construction in China, this paper pointed out that there were some problems in the current legal construction of ancient books protection, such as blind area of system and regulations, fragmentation of regulations, poor implementation of policies and so on. [Result/Conclusion] This study proposes to strengthen the construction of law governance system and improve the enforcement of the rule of law, and recommends that the management of ancient book hosting and other contents are incorporated into the legal provisions of protection, in order to promote the protection of ancient books towards good law and good governance.
