摘要

[目的/意义] MyData个人数据中介模式（简称MyData模式）被视为平衡数据流通与隐私安全的解决方案，并在多国实践。韩国率先探索政府主导的MyData模式，其经验可为我国数据中介治理提供参考。[方法/过程] 以初见成效的韩国MyData开展单案例研究，基于信息生态系统理论构建“主体—数据—环境”分析框架，剖析其治理逻辑。[结果/结论] 主体治理采取赋权数据主体、创建运营非营利性平台、强化数据处理者责任等措施，奠定流通合法性基础，保障流通主体权益，进而缓解数据供给不足；数据治理采取明确个人数据范围与推进数据标准化措施，提升数据的可流通性、兼容性与合规性，提高供需双方数据流通便利性；环境治理采取完善流通监管体系、激励企业创新服务，建立个人的信任，推动MyData生态建设，进而提升数据需求。

Abstract

[Purpose/Significance] The MyData personal data intermediary model, as a solution to balance data flow and privacy security, is applied in multiple countries. South Korea has taken the lead in exploring the government-led MyData model and analyzing its governance logic. It can provide a reference for data intermediary governance in China. [Method/Process] A single case study of MyData in South Korea, which is beginning to show results, is used to construct an analytical framework of “subject-data-environment” based on the theory of information ecosystems, and to analyze its governance logic. [Result/Conclusion] Subject governance takes measures such as empowering data subjects, creating and operating non-profit platforms, and strengthening the responsibility of data processors to lay the foundation of circulation legitimacy and safeguard the rights and interests of circulation subjects, thereby alleviating the shortage of data supply. Data governance takes measures to clarify the scope of personal data and promote data standardization to enhance the circulation, compatibility and compliance of data, and to provide a foundation for the supply and demand sides of the circulation of personal data. Environmental governance includes the measures to improve the circulation regulation system, incentivize enterprises to innovate services, build up individuals’ trust, and promote the construction of MyData ecosystem, thereby increasing data demand.
