Abstract

In this paper, we reviewed the existing measurement methods for patents in force, then according to the patent-stock theory and the updating features of patent law-status information, we designed a stock-ratio calculation model for patents in force based on the tracking mode. Furthermore, we proposed a patent-failure-rate coefficient to characterize the failure rate of patents in force, which derived from the negative exponential function index. An empirical analysis was carried out for a domestic institution. It was verified the above-mentioned stock ratio model in tracking mode and the patent-failure-rate coefficient could be employed jointly to demonstrate the dynamic evolution of the validity of the patents well. So they could be both used as important and effective analysis tools for patents in force. Finally, we discussed the future prospects of these indicators.
