Copyright Legislation of Orphan Works in America and Its Enlightenment

[Purpose/significance] This paper intends to obtain some inspirations through analyzing the process of American orphan works legislation and summarizing its successful copyright experience, to provide reference for the relevant research and orphan works legislation in China.[Method/process] Based on the analysis on the idea of balance of interests, historical evolution, the interests of the game and the path of choice etc., this paper systematically elaborates the status of the U.S. orphan works copyright legislation, and then analyzes the characteristics of the copyright legislation.[Result/conclusion] This paper proposes that the legislation on orphan works should mainly pay attention to the right license. Based on the concept of equitable interests, it should enrich the connotation of fair use doctrine, realize objective criteria of diligent search, incorporate orphan works into the management scope of collective management system and introduce extended collective licensing, to realize the value rationality of copyright system.
