Study on the Design of Fair Use Rules for Text and Data Mining in the Age of Artificial Intelligence

Abstract

[Purpose/significance] Based on the comparative analysis of the legislative or judicial responses to TDM behavior in the United States, the United Kingdom, the European Union, Japan and Germany, this paper puts forward the design idea of fair use rules of TDM in China. [Method/process] Firstly, the technical characteristics and challenges of text and data mining in the era of artificial intelligence were analyzed, and the differences between publishers and libraries on the fair use of TDM were introduced. Then, based on the comparative analysis of the legal response mechanism of representative countries on the fair use of TDM, from the subject, object, purpose, behavior and other conditions of TDM exception, this paper demonstrated the specific content of TDM fair use rule in China. [Result/conclusion] Text and data mining by reproduction, extraction, adaptation or limited dissemination of any work by any institution or individual for scientific research or other reasonable purposes constitutes fair use, but reasonable royalties shall be paid for the use of works from illegal sources.
